Terms and Conditions

Please read these Terms and Conditions carefully before you use our Services and make sure that you understand their content. These Terms and Conditions, together with the Privacy Policy, constitute a binding agreement between Shark77, its brand Titanplay.ca and you.

By registering an account at Titanplay you declare your full understanding and acceptance of these Terms and Conditions and the Privacy Policy and acknowledge that these shall apply to you. 

If you do not agree to any of these Terms and Conditions or the Privacy Policy, you must immediately stop using the Services.

These general terms and conditions of service come into effect on 19th September 2024. 

In this Agreement the following terms shall have the meanings assigned to them unless context suggests otherwise:
 “We”, “us”, “our”, “the Company”, “Titanplay”, “Shark77” or “the website” will be used interchangeably with Shark77 Limited.
 “You”, “Your”, “the Player”, Players”, “they” or “them” refers to any person who has opened an account on Titanplay.ca and as a result, has accepted these Terms and Conditions.
“Player Account” – refers to an account with us created on the website through which Players use our Services.
“Services” encompass all offerings, features, and functionalities, provided by Shark77 Limited, including but not limited to casino games, sports betting, transactions processing in the context of deposits made to the website, and the withdrawal of player funds, customer support, and others,
“Bet” – refers to the action of placing a wager on any type of game offered by Titanplay.ca.

Purpose and Acceptance 
 

1. Purpose of these Terms and Conditions

1.1. The objective of these Terms and Conditions is to govern the legal relations between Titanplay and the Player. By registering with Titanplay you declare that you understand these Terms and Conditions in their entirety and agree to be bound by them.

2. Acceptance of these Terms and Conditions

2.1. Shark77 Limited, a company registered in Malta and having its registered address at Vault 14, Level 2, Valletta Waterfront, Floriana, FRN 1914, Malta. Shark77 Limited is licensed and regulated by the Alcohol and Gaming Commission Ontario ("AGCO")  under the provisions of the Gaming Control Act, 1992, and the regulations thereunder, the standards, and other policies promulgated by the AGCO and are governed by the terms of its agreement with Internet Gaming Ontario ("iGO") for the purposes of operating and offering Internet gambling services to persons located in Ontario in accordance with the provision of the Criminal Code and provincial gaming regulations.

2.2. Shark77 Limited holds a remote gaming license with a license No. OPIG1299224, issued by the AGCO on 11.03.2024. Shark77 Limited is operating the brand and domain name www.titanplay.ca.

2.3. You may only use Our Services if you are physically located in Ontario, Canada.

2.4. By using, entering, and/or browsing any place or position (including but not limited to subdomains, source code, and/or website APIs, whether visible or not) of the Titanplay.ca website(s) or mobile application or other websites or applications that we own or operate (the “Website”) and/or by registering on the Website, players enter into an agreement with Titanplay.ca and agree to be bound by:

  • i. these Terms and Conditions.
  • ii. the Privacy Policy.
  • iii. the Policy on cookies.
  • iv. the Rules applicable to our Betting Products set out below collectively referred to as “the Terms”.

2.5. These Terms also apply to all mobile betting, including applications downloadable to mobile devices (i.e., provisions regarding the Website Terms and Conditions may be transferred to the Mobile Betting Terms and Conditions). You can at any time access these Terms online.

2.6. By placing a Bet or wager through the Website, Players agree to the rules in force for the relevant products on the Website. The Rules can be consulted in the relevant section of the website. Players can find the Betting Rules at titanplay.ca/pages/betting-rules.

2.7. The Terms may change from time to time for many reasons (including, but not limited to compliance with relevant laws and regulations and regulatory requirements and any changes thereto). Any changes will be announced on the Website. The latest version of the Terms and Conditions is always available on the Website. If a fundamental change is made to the Terms the player will be asked to agree to the new Terms before being able to access and use our Services again.  Players will still be allowed to withdraw their real money funds if they decide not to accept the amended Terms and Conditions, withdrawals being a subject of the latest accepted version of the Terms and Conditions.  

2.8. These Terms and Conditions shall be governed and interpreted in line with the provincial laws of Ontario and the federal laws of Canada. Any proceedings will be brought exclusively before the Canadian Courts. 
 

Player’s account

3. Requirements for opening an account:

3.1. In order to play with Titanplay and to use our services, players must complete the application for account opening and membership. 

3.2. By agreeing to these Terms and Conditions, you agree and declare that you have entered your own correct personal details and that the source of all funds used on the Website is derived from legal activities, and that you will not use the Website for illegal or fraudulent activity, including (and without limitation) money laundering as provided by the governing law that applies to you.

3.3. A person cannot request to open a Player Account or hold a Player Account if such person will not be the Player Account holder or if they are acting on behalf of a third party.

3.4. A Player must not authorize any third party to use their Player Account, but a Player will be entirely responsible for all losses which are incurred as a result of having a third party use their Player Account. The Player must immediately inform Titanplay if they suspect that another person has obtained access to their Player Account, and the Player will offer their full support to Titanplay while investigating this issue.

3.5. Players are allowed to open only one Player Account on the Website, and Titanplay reserves the right to close all multiple Player Accounts that are open, under the same name or connected to the same person. If a person has opened multiple Player Accounts on the Website, Titanplay will have the right to take any action permitted under these Terms and Conditions pertaining to these accounts. If Titanplay has reasonable grounds to believe that the Player has committed or attempted to commit any fraud, Titanplay reserves the right to cancel any transaction pertaining to it, without prejudice to any other action, or to terminate this Agreement.

3.6. We reserve the right to reject your Membership Application, and a Player Account may be closed, at Titanplay's sole discretion. Subject to these Terms and Conditions, including those terms which permit Titanplay to withhold payment of winnings, any contractual obligations of either a Player or Titanplay which have been made prior to a Player Account being closed will be applied.

4. Registration

4.1. Registration is allowed only once per person, family, household address, email address, payment account number, site cookies, IP address, and shared computer, i.e. public library or workplace, and cannot share any of the abovementioned with a previously registered account. This means that the player must register personally.

4.2. In order to be able to register an account, the player will be required to:

  • I. Be at least 19 years of age.
  • ii. Be physically located in Ontario, while using our services.
  • iii. Have the legal capacity to place wagers/bets/deposits by law.
  • iv. Not act on behalf of a third-party (even in the capacity of an authorized person).
  • v. Not be an excluded individual.

4.3. An excluded individual pursuant to 4.2.v. that Titanplay strictly prohibits from opening an account and performing any gaming activity on our website, is considered:

I. An individual who has been excluded by court order or any applicable law or regulation or any rule or policy.
ii. An individual who is executive, manager, director, employee, consultant, or agent in Titanplay, a Titanplay Group company or affiliated company, nor their relatives (in this clause, the term “relatives” means spouse, partner, parents, children or siblings of the people mentioned above), an employee of any seniority of any company providing services to Us or an employee of any seniority of the AGCO or iGO, are authorized to open or hold a Player Account or use the Service directly or indirectly. If this clause is breached, Titanplay reserves the right to close said Player Account immediately, void any Bets, and to cancel payments on any win.
iii. An individual who has been suspended by Titanplay from accessing their account and from creating new accounts for a specified period of time or indefinitely, due to responsible gambling reasons or as a result of the application of our Self-exclusion tool.

4.4. During the registration process, the player will be required to provide Titanplay with the following details, among others:

  • I. Full name - first name, middle name, and last name.
  • ii. Username
  • iii. Date of birth.
  • iv. Full residential address - country of residence, province, city, street name and building number, house/apartment number, postal/zip code.
  • v. Contact information – phone number and email address.
  • vi. Occupational information - the particular position occupied by you and the industry/particular employer you are employed at, including their name, business address, and phone number.

4.5.  The player takes full responsibility for ensuring that their contact details, payment details, and account information are accurate, precise, and up to date.

4.6. During the registration process you will be required to choose a username and password. Titanplay allows all its players to choose their own combination for their account. However, your username must not be obscene, threatening, racist, offensive, derogatory, defamatory, or infringe any intellectual property right or property right of a third party.  If at Titanplay’s discretion, your username is considered to be inappropriate you will be asked by customer support to create a new account complying with the requirements, while we close the old account. Should you refuse this request Titanplay reserves the right to terminate the business relationship.

4.7. It is your sole responsibility to keep your account details secret and to protect them from unauthorized access.

4.8. Players are prohibited from selling, transferring, and/or acquiring accounts from other players.

4.9. Players are not allowed to transfer funds from their account to another player’s account.

5. Player’s personal information

5.1. Titanplay takes extraordinary measures to guarantee the safekeeping of all information that has been provided.

5.2. Your personal data shall be kept confidential and will be processed in accordance with our Privacy Policy. We will not disclose your personal data or betting information unless compelled to do so by any applicable laws, regulations, court orders, or by the relevant gambling authorities. We reserve the right to disclose your personal data to our service providers to the extent necessary for using the Services.

5.3. As part of the registration process, we may share player details with authorized credit reference agencies and third-party identity verification companies to verify the player's identity and payment details. Players hereby declare their consent to the use of corresponding information on our part in connection with their registration. 

5.4. It is the responsibility of the Player to protect their payment methods against loss or theft.

5.5. Titanplay presumes that all transactions are made by the rightful owner of the Player Account and are therefore valid. In no case is Titanplay liable for losses incurred by the Player due to unauthorized use or misuse of their personal details.

6. Verification

6.1. You can only use the Website and the Services if you are at minimum the legal age for gambling in Ontario - 19. 

6.2. Titanplay reserves the right to request proof of age and identity of a player, at any time, to prevent access to the website by minors and to suspend betting accounts until satisfactory proof of age is provided.

6.3. By registering an Account and agreeing to these Terms and Conditions, you authorize us to verify and confirm your identity and age.

6.4. In order to confirm the player's address, Titanplay might require additional documentation for address verification purposes.

6.5. Titanplay has the right and obligation to request the player to provide us with personal identification documents, source of wealth/funds documents, and other documents, as needed, to verify the player’s identity upon player registration or at any stage of their activity, including if said documents have expired or if we have reasonable doubts as to the validity and/or authenticity of the documents provided previously. Similarly, Titanplay must request the player to specify to which player’s owned payment account any withdrawal should be transferred. 

6.6. All documents supplied must be valid, authentic, and complete copies of the originals. If this is not the case, we reserve the right to block the account and void any deposit made into the account, along with any winnings from such deposits.

6.7. Upon providing the registration information you will have a Pre-Activated Account. A pre-activated is a NON verified account. While having a pre-Activated account you can update the personal details on record, set limits, and generally navigate around the platform but without the ability to play any games.
 

Player’s rights and responsibilities

7. We hereby grant you personal and non-transferable access to use our Services in line with these Terms and Conditions and subject to the following conditions:

7.1. You are at least 19 years of age, and you are able to assume responsibility for your actions.

7.2. The information that you enter in the registration form is true, accurate, and complete. You are the rightful owner of the documents, supplied to verify your account and the owner of all payment methods used in the account. We reserve the right to close your Player Account if the information provided to Titanplay is found to be false, inaccurate, deceitful, or incomplete. It is your responsibility to inform us of any changes regarding the information you provided us with as soon as possible.

7.3. You may not under any circumstance authorize a third party to use your Player Account, your password, or your identity to access the Services. 

7.4. You understand the rules and procedures of all games offered on the Website.

7.5. It is your responsibility to note the payout rate or odds that apply to each game before you place a Bet, and you acknowledge that payout rates and odds change from time to time.

7.6. You acknowledge that when playing games of chance using the Services means that you are at risk of losing money. It is your sole responsibility to assume the losses suffered through your Player Account. 

7.7. You acknowledge that our Services are consumed instantly when playing. Thus, we cannot provide returns of goods or refunds or, subject to any terms to the contrary, cancellation of your Bets once they have been placed. If you play a game on the Website with real money, the money will be drawn from your Player Account. 

7.8. You acknowledge that the use of any third-party software (often referred to as robots or bots) is strictly forbidden and if detected will result in the forfeiture of any accumulated winnings and the immediate closure of the player's account. Such types of robots or bots include but are not restricted to automated software being used to access the services Titanplay offers, place Bets for the player, or make gaming decisions for the player. Titanplay retains the right to take reasonable legal measures to reclaim invalid winnings in cases where historical instances of bot use are detected after cash outs have been paid.

7.9. You acknowledge that it is strictly forbidden for a Player to sell, transfer, and/or acquire Accounts to/from another Player or transfer funds from their Account to another Player’s Account. 

7.10. You will not attempt to use any techniques designed to hide or mislead as to your IP or true location.

7.11. You will not be depositing funds obtained through unlawful or unauthorized means, as this practice is in direct violation of applicable legal statutes. Each financial transaction is subjected to comprehensive scrutiny to effectively mitigate the risks associated with money laundering activities.

7.12. You acknowledge that it is your responsibility to provide and maintain all the necessary computer equipment, telecommunication network, and internet access services required to use the Services. The site is not obligated to provide any equipment or perform maintenance on your devices for accessing its services.  

7.13. You warrant you are not colluding or attempting to collude in any scheme with any other Player while betting.

7.14. You agree to refrain from any actions constituting bonus manipulation, breach of the Terms & Conditions (T&Cs), or violation of the betting rules outlined by Titanplay. By participating, you acknowledge and agree to adhere to these standards. Failure to comply may result in account suspension, forfeiture of winnings, or other penalties, at the discretion of Titanplay.

7.15. You warrant you will inform us as soon as possible if you become a domestic politically exposed person in Canada (‘domestic PEP’), a foreign politically exposed person (‘foreign PEP’), a head of an international organization (‘HIO’; together with domestic and foreign PEPs, ‘PEP/HIO’), or the family member or close associate of a PEP or HIO (a ‘PEP/HIO Related Person’), or if you no longer occupy such position.  
 

Titanplay’s rights and responsibilities

8. Titanplay’s rights and responsibilities include:

8.1. Titanplay is not responsible for any potential access to a Player’s Account by a third party and will not be held responsible for any potential loss suffered due to the illicit use of a Player’s password by a third party without authorized access, and/or for any transaction in which the name and password of a Player were registered correctly.

8.2. Titanplay will use your personal data to allow you to use the Services and to carry out operations relevant to your participation. We may also use your personal data to inform you of changes, new services, and promotions that we think you may find interesting. If you do not wish to receive such direct marketing data, you may opt out of such a service. Titanplay will not exchange and/or distribute email addresses or a Player’s personal information with third parties.  

8.3. Titanplay reserves the right, at its sole discretion, to report any suspicious transaction and to transmit any information to the appropriate authorities, and without notice to you. In addition, Titanplay reserves the right to withhold all the funds we believe to be derived from cheating, fraudulent, or unlawful activity.

8.4.Titanplay reserves the right to investigate or pursue complaints made by a player against any other player only in cases involving cheating, collusion, or unfair treatment as detailed in the iGO's Customer Care & Dispute Resolution (CCDR) requirements. 

8.5. Titanplay reserves the right, at its sole discretion, to suspend, modify, end, revoke the use of, and/or add elements to its Services, either temporarily or permanently, at any time without notice or compensation.

8.6. To comply with legal and regulatory obligations, Titanplay operates an anti-money laundering policy that, from time to time, may require us to request documentary evidence to justify your activity. This will be communicated to you directly by email or other available channels, with the request including a list of acceptable documentation. All information received is stored securely in accordance with our Privacy Policy.

9. Bets 

9.1. Titanplay accepts Bets made online via its website Titanplay.ca and mobile app. Bets are not accepted in any other form (e-mail, fax, etc.). 

9.2. All Bets will be processed once the Bet has been placed and the acceptance confirmed. 

9.3. Titanplay reserves the right to offer different odds on specific Bet types in comparison to the odds presented for individual single Bets.  

9.4. Players cannot cancel or change a Bet once it has been placed and confirmed.  

9.5. All Bets and wagers are subject to the requirements applicable to each individual game. You can become familiar with the respective requirements on our website https://titanplay.ca/pages/betting-rules

9.6. Titanplay reserves the right to suspend any markets/sport event activity and/or cancel any Bet/wager at any time. In the event of a market/sport event being suspended, all incoming Bets will be rejected ad hoc. We reserve the right to declare Bets closed at any time without notice. 

9.7. The time accuracy calculation on the website is for informational purposes only. Bet calculations are based on the stake and odds at the time in which the Bet is settled. In the case of multiple Bets/accumulators with one or more invalid selections, the calculated betting yield will be reduced accordingly. 

9.8. All the betting winnings are credited to the player's betting account. Amounts of money/winnings that have been mistakenly credited to a betting account will not be available to the player. Titanplay reserves the right to cancel any transaction involving such funds and/or withdraw the relevant amount from the player's account and/or reverse any such transaction, either at the relevant time or subsequently. Moreover, Titanplay reserves the right to void any transactions which were made by mistake. 

9.9. Titanplay reserves the right to hold onto payments and void Bets on any event/sports etc., if there is suspicion of any of the following: 

  • i. The integrity of the event is in question.
  • ii. The odds(s) have been manipulated.
  • iii. An illegal collusion took place during the game.  
  • Indications of the above may be based on the size, volume, or pattern of Bets placed through one or more of Titanplay's betting channels. A decision made by the responsible governing body of the sport (if made) is to be regarded as final. If a player owes money to Titanplay for any reason, we reserve the right to take this into account before making any payment to that player. 

9.10. If We have a reasonable suspicion that multiple Bets which befall the same selection(s) have been placed by or for the same person/syndicate, Titanplay reserves the right to void any Bet or withhold payment of winnings until the suspicion is ruled out. 

9.11. Live Betting: In cases where there is reason to believe that a Bet has been placed after the outcome of the event has become known or after the selected competitor or team has gained a material advantage (e.g., winning a point/goal), Titanplay reserves the right to void the Bet regardless of the outcome of the Bet. 

9.11.1. Live Bets will be accepted up to the advertised start time. If a Bet is inadvertently accepted after the advertised start time, the match/Bet will be treated as a 'non-runner', and therefore considered void.  

9.12. A Bet may be voided/cancelled because an event mentioned in the exceptional circumstances section has taken place. A voided Bet will not be considered wagered. 

9.13. Multiple Bets combining different selections within the same event where the outcome of one affects or is affected by the other are not accepted. If such Bets are mistakenly accepted, these will be cancelled, and the wager placed returned to the player’s account.   

9.14. In Ontario, pay-to-play fantasy sports are a form of gambling under the Criminal Code of Canada and are only permitted under the AGCO’s internet gaming standards. 

9.15. The events on which Titanplay’s players will be allowed to Bet will comply with the requirement that the majority of participants in the event or league should be 19 years of age or older.

10. Exceptional circumstances

10.1. In cases where a Bet has not been processed yet, Titanplay reserves the right to limit, refuse, cancel, change any Bet or part of a Bet before the game starts without providing any justification. After acceptance of a Bet, Titanplay reserves the right to limit, refuse, cancel, change any Bet or part of a Bet if exceptional circumstances occur. These exceptional circumstances include, but are not limited to: 

  • i. Force majeure.
  • ii. Manipulations of sport events like doping, rigging, or other kinds of distortion by participants or parties with influence on the competition. 
  • Titanplay will monitor the integrity of all events using a third-party provider (https://www.usintegrity.com/) in order to provide every player with accurate events and avoid any match-fixing and manipulated events and tournaments. 

10.2. Titanplay reserves the right to terminate and remove games from its website as it deems fit. 

10.3. When an event is cancelled, all related Bets will be cancelled automatically, and any wagers placed will also be refunded to the player’s gaming account. 

10.4. Titanplay will not be responsible for any damages or losses deemed or alleged to have resulted from or which have been caused by the Website or its content including without limitation, delays or interruptions in operation or transmission, loss or corruption of data, communication or line failure, server disruption or lagging, downtime, any person's misuse of the site or its content, or any errors or omissions in content. 

10.5. Titanplay will also not be liable for any system errors in gaming software, pay tables, random number generation system, Bet settlement, or any other elements of Titanplay Limited’s product/s. 

10.6. Titanplay does not take any responsibility for typing, human, or palpable errors, which can lead to obvious price errors. In any of the instances mentioned above, Bets will be deemed void. These will be cancelled, and the wagered amount returned to the player’s account. 

10.7. Section 10.6, sentence three doesn’t apply in cases of intent or gross negligence by Titanplay. 

10.8. Though we strive to ensure that no technical hitches take place, a failure in the system may still result in your game aborting or being interrupted. In that event, we will either resume the game at the point in time immediately before the interruption took place or, if this is not possible, terminate the game and refund the amount of the Bet you initially wagered before the interruption took place, to your player account. 

10.9.  Although every effort is made to ensure that information displayed on the website with regard to an event is correct, it is to be used as a guide only. In the event of any information (score, time of game, etc.) being incorrect we assume no liability for this. Please refer to our Betting Rules found on our website to be able to understand how we settle individual markets. 

10.10. Titanplay reserves the right to void any or all Bets made by any player or group of players acting in an attempt to defraud the website. If there is evidence of Bets, each containing the same selection which had been placed by or for the same individual or group of individuals and this results in reasonable suspicion of fraudulent behavior, Titanplay Limited reserves the right to make such Bets void and suspend the players’ accounts. This rule applies to both settled and unsettled Bets. 

10.11. Titanplay reserves the right to void any Bet that may have been accepted in error when the player’s account did not have sufficient funds to cover the Bet. Titanplay may also act in such a manner if an account has insufficient funds as a result of a deposit which had been cancelled by the payment processing party. 

10.12. Should funds be credited to a player's account by mistake, it is the player's responsibility to notify us of the error once they become aware of such a mistake. If, on the other hand, it is Titanplay that becomes aware of this mistake, we will deduct the amount from the player’s account without prior notice to the player. Any winnings subsequent to the error shall be deemed invalid and will be voided.
 

Deposits and Withdrawals 

11. All payments between Titanplay.ca and its players are handled by Titanplay. 

11.1. Any deposits are specifically to be used on our website. Accordingly, Bets can only be placed up to the amount of the available account balance.

11.2. Deposits can only be made from funds that were obtained legally. Each transaction is in fact checked to prevent money laundering. Titanplay will report any criminal or suspicious activity to the relevant authorities, without warning to the player. 

11.3. You should only deposit funds into your Account for the sole and specific purpose of using such funds to place Bets/wagers on the Website. If we reasonably believe or have reason to believe that you are depositing funds without intending to place Bets/wagers, we have the right to suspend or close your account. In this case, the responsible authorities may also be informed. 

11.4. You should only fund your gambling account from sources for which you are the account holder of record. In cases where Titanplay.ca determines that the name of the Account Holder is different from the name registered in the Titanplay.ca account, we reserve the right to void any deposit made into the player’s account and any winnings derived from such deposit. 

11.5. Funds deposited with us are held by our bank in designated player accounts separate from our own accounts. 

11.6. Titanplay does not issue any credit and Bets must be covered by sufficient funds in the player's account. Titanplay reserves the right to void any Bet/wager which may have been accepted in error when there were insufficient funds in the account to cover the stake/wager. Should a player's account be credited with funds in error, the player must notify Titanplay.ca immediately. Such amounts will be recovered by Titanplay via an account adjustment. 

11.7. The official currency of the website is the Canadian Dollar (CAD). 

11.8. Titanplay has the right to withhold any money made or received by the Player through or in connection with any “unlawful” use of the Website (including activities not undertaken for a lawful purpose). 

11.9. Titanplay does not charge any fees for deposits made. However, please note that based on the bank, conversion, or payment provider additional fees may arise that are outside Titanplay’s control. 

11.10. The minimum accepted deposit is CAD 20. Participation on credit is prohibited.

11.11 Customers can only have one pending withdrawal at a time. 

11.12. Any money deposited is specifically to be used on our website. Unless stated otherwise, any deposited amount will need to be wagered at least once before the player is allowed to withdraw the funds.

11.12.1 The following Bet statuses count towards the customer`s general rollover: 

  • 100% of all “win” and “loss” real money Bets
  • 50% of all “tie/win” and “tie/loss” real money Bets 
  • any cash out, cancelled or declined Bets or such with virtual funds do not count towards the wagering
  • if the Bet is made using real and bonus funds, only the part of the stake made with real money will be counted towards the customer’s rollover

11.13. Titanplay is not a financial institution and, thus, any deposits made into your account are not due to any interest payments. For the avoidance of doubt, we are not going to be treated as bankers or debtors of our players and the balance on the player account will not be subject to the protection afforded by the bank/deposit insurance schemes applicable on the provincial or federal levels. Titanplay does not provide advice regarding tax and/or legal matters. Players who wish to obtain advice regarding tax and legal matters are advised to contact appropriate advisors. You are solely responsible for any applicable taxes on any prizes and/or winnings that You collect from Titanplay. 

11.14. It is the Player's responsibility to report any gains or losses to the appropriate financial and/or other authorities in the relevant jurisdiction in which the Player resides.

12. Whenever possible, withdrawals will be made to the account from which the deposit was made. Withdrawals can only be made in the name of or to the registered and verified account holder. 

12.1. Withdrawals can be made by clicking on Withdraw on the website, provided the amount is covered by sufficient funds in the account. 

12.2. A player can at any time withdraw money from his account, provided this transaction complies with these Terms and Conditions.

12.3. To cover administrative costs, Titanplay sets a minimum withdrawal amount of CAD20. 

12.4. Titanplay applies the closed-loop-rule, according to which withdrawals are allowed to the same payment account used to previously deposit the funds. However, if the player chooses to use a different payment account for withdrawals, Titanplay shall process the withdrawal once it fully verifies and ensures that: 

  • i. This payment account does belong to the player himself (is operated under the player’s name).
  • ii. This payment account is not used by any other player already.

12.5. Should Titanplay incur chargeback fees, cancellation fees, or any other charges related to a player's account, we reserve the right to seek reimbursement from the player for the total amounts incurred. Any winnings accumulated using funds from transactions, which have been charged back, reversed, or otherwise cancelled may be forfeited and Titanplay reserves the right to, at its sole discretion, terminate its relationship with the player, should misuse or attempted misuse of the aforementioned payment dispute tools be suspected.

12.6. Any amounts owed to Titanplay.ca or any company in the Titanplay group may be set off against any positive balance in a player's account at any time. 

13. Titanplay has entered into an agreement with several payment service providers and financial institutions so that the latter are able to receive deposits and process withdrawals on its behalf. Deposit timing and charges vary depending on the payment method opted for. When you wish to withdraw money, payments generally will be made as soon as reasonably possible (subject to internal processing time of up to five (5) business days).  

14. Maximum Winning and Withdrawal Limits

14.1 The maximum winning amount per Bet is CAD40,000. 

14.2 The player’s maximum winning amount per day of any type or kind cannot exceed CAD130,000.

14.3 You acknowledge and agree that while higher potential payouts may be displayed when placing a Bet, our obligation is limited to the payout limits specified in these Terms and Conditions. You will not be entitled to claim any winnings beyond these stated limits.

14.4 The maximum total approved withdrawal amount in a 7-day rolling period cannot exceed CAD 5,000. 

14.5 The maximum number of withdrawals in a 7-days rolling period is one.

14.6 Different limits may be available for VIP members, only if confirmed by Titanplay via email, explicitly stating the amount and scope of the updated limits. 

15. Titanplay is not responsible for any failures or delays that might be caused due to restrictions/problems which the payment providers may be faced with. 

16. Titanplay reserves the right to review transaction records and logs whenever it deems this to be necessary. If following these reviews, it becomes clear or it is suspected that the account is being: 

  • i. Used as a non-recreational play type; or 
  • ii. That players are colluding and thereby distorting the gameplay, or 
  • iii. are in any manner not complying with these terms and conditions, Titanplay will then cancel all withdrawals and all winnings will be revoked. In any case, the player will not lose the right to withdraw the amount originally deposited. In addition, Titanplay reserves the right to suspend such accounts

 

Player Protection
 
17. At Titanplay we take gambling-related harms and responsible gambling very seriously and we provide a range of options to the players to reduce gambling-related harm and to help them gamble responsibly. Players are able to set limits and to review those on a regular basis in order to have a responsible gaming experience. 

18. Break in Play

a. Players have the option to initiate a short-term break "Break in Play" in their play. The break in play periods are: 

  • i. One (1) day, 
  • ii. Seven (7) days,  
  • iii. One (1) month, 
  • iv. Two (2) months, 
  • v. Three (3) months. 

b. During this "Break in Play" period the player is not able to make any wagers.

19. Deposit/Loss/Turnover limits 

a. Players can set limits on the amount of money which can be deposited or lost during a specific period upon registration and at any time after registration. Any Titanplay players will be provided with the option to these limits after registration. The period or duration of that limits include: 

  • i. 24 hours.
  • ii. 7 days.
  • iii.1 month. 

b. Where the player sets simultaneous periods (e.g., a deposit limit for a day and for a week), the lowest limit shall apply.  

c. If the player requests to relax (increase the amount of the limit) or to eliminate the limit, this request will apply at least after a 24-hour cooling-off period.

20. Self-exclusion

a. We realize that for some players gambling might become a serious problem. For them, we offer a self-exclusion option for a definite period, as per the player's request or other indication. If you would like to self-exclude yourself, please refer to the Responsible Gambling page of our website, or feel free to contact us at [email protected]. Please note that any exclusion might be registered in a central blocking system, once such is created, and that Titanplay Limited has no influence on “un-blocking” of players once they are registered in the central blocking system. 

b. Players can self-exclude from gambling through the self-exclusion option for terms lasting: 

  • i. 6 (six) months. 
  • ii. 1 (one) year.
  • iii. 5 (five) years. 

c. Each player must, after a self-exclusion request submission, be immediately logged out of their account and unable to login for the duration of their exclusion. 

d. You confirm and acknowledge that in case you self-exclude, you shall be banned from using your player account and prevented from opening a new account during your selected self-exclusion period until such self-exclusion has been lifted. 

e. Titanplay will cancel any open Bets or future game transactions for self-excluded players which will occur in the future.

f. Titanplay.ca is obliged to return any unused funds to a self-excluded player, only upon the player’s request, in line with applicable law. 

g. Titanplay will be required to participate in a coordinated, centralized self-exclusion program, that shall be in place to allow players to automatically exclude themselves from all online Operator platforms, including OLG, and from centralized self-exclusion programs developed by iGaming Ontario during the Term pursuant to the iGaming Ontario Policies.

i. During the exclusion period, all efforts will be made to exclude you from betting. However, you must not attempt to Bet with us, and we cannot be responsible or liable for any subsequent consequences or losses (howsoever caused) that you may suffer or incur if you continue gambling through additional player accounts where you have altered any of your registration details or provide misleading, inaccurate, or incomplete details or otherwise seek to circumvent the self-exclusion. No winnings generated on a player account that is in breach of a self-exclusion agreement will be processed, with additional funds voided and the total deposit amount returned to the payment method initially used.

f. Once the self-exclusion period expires, the account will remain closed, unless you proactively request reactivation. The reactivation process includes mandatory conversation with the customer protection team and a 24-hour cooling-off period after. 

g. The marketing communications are switched off upon self-exclusion activation and will remain switched off unless you proactively request to turn them on. 
 

Account closure

21. A player may wish to close their account. Account closure may be facilitated through the “Deactivate Account” button under https://titanplay.ca/my/responsible-gaming, or via email from the email address registered in the account, to [email protected]. Account closure requested directly through the website is immediately actioned by the system. For account closure requested through the Support email address, please allow up to 24 hours to process and action the request. If a player has a remaining positive balance upon closing the account in accordance with this section, any eligible unused funds shall be returned to the player, upon the player’s request, in line with applicable law. Titanplay will undertake all feasible efforts to reach the player if, for whatever reason, the remaining assets cannot be transferred back to the verified payment account.   

21.1. In case of unsuccessful remitting the remaining balance to the player, the Account will:

  • i.either be frozen or,
  • ii. will be closed and the remaining balance will be forfeited by the player and donated in accordance with section 22.2.

21.2. Titanplay may only elect to donate the remaining funds in the Account to an NGO dealing with the prevention of problematic gambling and gambling addiction and providing support to persons suffering from or being affected by problematic gambling or gambling addiction, if the following conditions are satisfied:

  • i. After failing to remit the funds, Titanplay shall send the player a final notice informing him that the funds shall be donated, if they do not provide a means for the funds to be remitted within a specified timeframe, after the lapse of 12 (twelve) months from when the final notice has been sent to them.
  • ii. Such notice shall be sent to the player through every means of communication available to Titanplay

22. Titanplay hereby reserves the right to close or suspend an account at any time for any reason. Subject to the full validity of the foregoing provision, Titanplay reserves the right to close or suspend an account, if:

  • i. Player becomes insolvent. 
  • ii. Titanplay believes that the Website is being used fraudulently or for any illegal and/or unlawful or unethical purpose.
  • iii. Titanplay believes that the use of the Website has not been conducted in accordance with rules of fairness or willingness to cheat or unfairly gain a competitive advantage over Titanplay.ca or its players or the Account is being used for the benefit of a third party.
  • iv. Titanplay is required to do so in order to perform its legal or contractual obligations, is required to do so by the police, a regulator, or a court order
  • vi. Player’s Account has been deemed inactive and the Account Balance is zero or falling to zero or is otherwise closed. 
  • vii. Player has more than one account.
  • viii. Player provided incorrect personal details while registering a Player Account or provided personal details belonging to another person.
  • ix. The player has acknowledged that he is, or we reasonably believe he is suffering from a problem related to gambling addiction.
  • x. The player allowed, intentionally or unintentionally, another person to use their Player Account or they have otherwise misused their Player Account.
  • xi. Player has breached any of these Terms and Conditions.

22.1. If Titanplay closes or suspends an Account for any of the reasons above, the account holder shall be liable for all claims, losses, liabilities, damages, and costs and/or expenses incurred on Titanplay.ca (collectively the "Claims") or onto the players. 

22.2. If any of the circumstances set out in paragraphs (i) to (vi) occur, Titanplay shall further have the right to withhold any payment that would otherwise have been paid or due to the player (including winnings, Bet Credits, and bonus payments.).
 

Dormant 

23. If there is no activity on an account for a period of 365 days or more, the account will be deemed Dormant (inactive) and, if the account balance is zero, it will be closed with no charge.

24. If there is a positive cashable balance in your Account when it is determined to be inactive, Titanplay will take reasonable steps to notify you using the information you provided (or updated) at registration, giving you 28 days to instruct us on how to refund any money left in your account (the “Notice Period”). In case we are unable to refund your money, or you have not withdrawn the cashable balance from the dormant account within the Notice period, any outstanding balance will be donated to as per paragraph 21.2.

25. You may “reactivate” your Account by: 

  • i. making a successful deposit; or 
  • ii. placing a Bet.

 Complaints and Disputes

26. Titanplay complies with all the Customer Care and Dispute Resolution (CCDR) requirements outlined in iGO’s policies. You have a right to recourse to:

  • i. Our Complaints team via the following email [email protected] in terms of any inquiries, issues, and complaints related to your gameplay, account status, player account management, payment issues, technical issues such as the site being down, games being down for maintenance, etc. You should raise any complaints concerning, but not limited to, the issues outlined above with our Complaints team, prior to addressing the entities mentioned in (i) and (ii) (below). 
  • ii. iGaming Ontario (iGO) via its dedicated webpage (Player Support | iGaming Ontario). 
  • iii. The Alcohol and Gaming Commission of Ontario (AGCO) via its dedicated webpage (igaming-complaints-and-inquiries-q1 | Alcohol and Gaming Commission of Ontario (agco.ca).
  • iv. Our Customer Support team via live chat or via the following email [email protected] to report activities related to collusion and cheating, including the suspected use of bots. In any case, the identity of a player that reports to us such concerns will be kept confidential.

26.1. If your complaint or report relates to a topic such as Responsible Gaming, Suspected Illegal Activity, Collusion, and Cheating, including the suspected use of bots, or Advertising, or any other form of suspected serious misconduct, where you consider that referring the complaint to Our Customer support team may not be appropriate, you can address the AGCO directly or submit your complaint to iGO, which in turn is going to refer it to the responsible regulator/agency. 

26.2. Our Complaints team will do its best to provide the player with an initial reply within 48 hours of the player’s dispute or complaint. Titanplay will strive to resolve any occurring player complaint within 14 business days. In any case, the outcome of the complaint/dispute will be communicated within a maximum of ninety (90) days from receipt of the player’s request. In exceptional circumstances wherein we feel that adequate resolution of the complaint requires further investigation, Titanplay may extend the timeframe. We shall be informing you about this delay within the first ten days of receipt of the complaint. In that case, we will also inform you about the process, and possibly also put forward the necessary requests as deemed necessary. 

26.3. Complaints team will process and respond to your complaint, without incurring any fees/charges onto you for the services rendered onto you, in relation to handling your complaint. If your complaint has not been handled to your satisfaction due to reasons including, but not limited to its outcome or the lack of response within 90 (ninety) days, you can launch an appeal against Shark 77 Limited by addressing the entities, mentioned in Section 27 (ii) and (iii). 

26.4. The AGCO or iGO (depending on your choice of appeal/escalation) will examine the circumstances of the dispute to decide the outcome thereof. Both entities provide impartial services for disputes that have arisen between players and Operators (in this case – Shark77 Limited). This service is provided free-of-charge to players. 

26.5. The player should first try to resolve the dispute via Titanplay`s internal complaints procedure. It is only once this attempt has not been fruitful that we suggest appealing to the regulatory entity of your choice. 

26.6. Once the entities outlined in section 27 (i) and (ii) adjudicate your case, their final decision is binding vis-à-vis both the player and Titanplay. This therefore means that players may only seek further legal and judicial recourse regarding matters allowed by applicable law. Such circumstances usually include, for instance, situations where the above-mentioned entity has acted in a manner contrary to the rules of impartiality and equity according to law and such action has thereby prejudiced the player’s rights. 
 

General

27. Force Majeure
Titanplay shall not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under the gaming contract that are caused by events outside our reasonable control. Although we shall take all reasonable measures to ensure that the Software and files are free from computer viruses we cannot and do not guarantee that the Software and files are free of such problems. It is your responsibility to protect your systems and have in place the ability to reinstall any data or programs lost due to a virus. 

28. Service suspension
We may temporarily suspend the whole or any part of the Service for any reason at our sole discretion. We may, but shall not be obliged to, give you as much notice as is reasonably practicable of such suspension. We will restore the Service, as soon as is reasonably practicable, after such temporary suspension.

29. Assignment
These Terms and Conditions give rise to rights and obligations related to you personally, and they are not assignable, transferable, or sub-licensable by you except with our prior written consent. We reserve the right to assign, transfer or delegate any of our rights and obligations hereunder to any third party. 

30. Severability
If any of the Terms are determined by any competent authority to be invalid, unlawful, or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law. In such cases, the part deemed invalid or unenforceable shall be amended in a manner consistent with the applicable law to reflect, as closely as possible, Titanplay Limited’s original intent. 

31. Liability

31.1. Titanplay shall not be liable for any damage, liability , or loss arising out of or in connection with the website or its content (including delays or interruptions in operation or transmission, loss or corruption of data, transmission or wagering errors, any misuse of the website or its content or any error or omission in the content, hacked accounts, suspended accounts, fraud actions, etc.,) occurring or alleged to have occurred in connection with the website or its content. 

31.2. We make no representation or warranties of any kinds in terms of the compatibility, functionality, performance, or operation of the website or any of the associated services, products, and components thereof, with the devices used by the players, who access our platform. The latter have the responsibility to procure and maintain a device and a connection, which would allow them to access our platform and participate in the different eligible games offered there. 

31.3. Titanplay is responsible for providing all efforts to ensure the accuracy of the information on the website but does not warrant the accuracy or completeness of the information and materials on the website. There may be spelling mistakes or other inaccuracies on the website, or information that is no longer up to date. Titanplay is under no obligation to update any such material. The information and materials on the website are provided "as is" without any representations warranties or other conditions of any kind. 

32. Intellectual Property Rights

32.1. The content of the website is protected by international copyright laws and other intellectual property rights. Titanplay, its advertising partners, and other third-party licensors own these rights. 

32.2. Product and company names and logos mentioned on the website are trademarks, service marks, or trade names of their respective holders, including Titanplay Limited and iGaming Ontario. 

32.3. Except to the extent necessary to use any product or place Bets and wagers, no part of the website may be reproduced or stored, modified, copied, republished, uploaded, published, forwarded or distributed, or incorporated into any website or any electronic record management and retrieval system or service, public or private, including text, graphics, video, messages, code and/or software whatsoever related to Titanplay.ca.

32.4. Titanplay grants you the non-exclusive and non-transferable right to install and use the Software and the website, solely for your personal non-commercial use. You must not: 

  • i. Copy, redistribute, publish, reverse engineer, decompile, disassemble, modify, translate, or make any attempt to access the Software or website to create derivate works of the source code, or otherwise, 
  • ii. Sell, assign, sublicense, transfer, distribute, or lease the website and or the Software,
  • iii. Make the website and or the Software available to any third party,
  • iv. Use the website and or the Software in any way that is banned by all applicable laws or regulations. 

32.5. You will be solely liable for any damage arising out of or in connection with any of the above prohibitions. Furthermore, you acknowledge and confirm that you shall notify Titanplay and provide all required assistance if you become aware of any of the above-mentioned prohibitions.
